Terms of Service & User Agreement

1. Acceptance of Terms

By accessing, browsing, or using the software platform located at https://feedboss.ai (the "Site"), our browser extension, and the tools, services, and dashboards provided therein (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by this User Agreement ("Agreement").

This Agreement is a legal contract between you ("User," "Customer," or "You") and Feedboss.ai ("Company," "We," or "Us"). If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree with these terms, you must immediately cease use of the Services.

2. Service Description & LinkedIn Disclaimer

2.1 The Solution

Feedboss.ai provides a software-as-a-service platform that helps users create, generate, edit, schedule, and publish content for LinkedIn, and analyze growth and engagement metrics. Content is produced with the assistance of artificial intelligence across formats such as text posts, carousels, slide decks, infographics, video, and lead magnets.

2.2 Platform Independence

Feedboss.ai is an independent entity and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with LinkedIn Corporation, Microsoft, or any of their subsidiaries or affiliates. The name "LinkedIn" as well as related names, marks, emblems, and images are registered trademarks of their respective owners.

2.3 LinkedIn Compliance and Account Responsibility

Publishing to LinkedIn is performed through LinkedIn's official API. You are responsible for using the Services in accordance with the LinkedIn User Agreement and applicable platform policies. Because your LinkedIn account is administered by LinkedIn and not by us, we are not responsible for any restriction, suspension, or other action LinkedIn may take in relation to your account.

3. Account Registration & Security

3.1 Eligibility

You must be at least 18 years old to use our Services. By registering, you warrant that all information provided is accurate, current, and complete.

3.2 Account Credentials

Sign-in is provided through a third-party authentication provider or a one-time email code. You are responsible for maintaining the security of the account and email you use to access the Services, and you accept responsibility for all activities that occur under your account. You agree to notify us immediately at hello@feedboss.ai if you suspect any unauthorized use of your account.

3.3 Suspension and Termination

We reserve the right to terminate or suspend your account access at any time if we suspect a violation of these Terms, illegal activity, or unauthorized access.

4. Subscriptions, Billing, and Credits

4.1 Free Trial

We may offer a time-limited free trial. The trial does not require a payment method and does not automatically convert into a paid plan or charge you. To continue using paid features after the trial ends, you must actively subscribe through our checkout. Paid access begins once your first payment is successfully processed.

4.2 Subscription Fees

Access to premium features requires a recurring subscription (Monthly or Annual). Fees are billed in advance. By subscribing, you authorize us (or our third-party payment processor) to charge your payment method for the applicable fees and taxes.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date. You can manage or cancel your subscription through your account dashboard, and cancellation takes effect at the end of the current billing period.

4.4 Refunds

Except where required by applicable law, or where we choose to issue a refund at our sole discretion, fees for recurring subscriptions are non-refundable, and we do not provide refunds or credits for partial billing periods or for time during which the subscription was not used. If we issue a refund, the related access may end. Lifetime and marketplace purchases are governed by Section 4.7.

4.5 Price Changes

We reserve the right to modify our pricing tiers. Any price changes will be communicated to you in advance and will take effect at the start of the next billing cycle.

4.6 Credits and Usage

Use of the Services is metered in credits. Certain actions, such as generating content or reading LinkedIn data, consume credits in the amounts shown within the Services. Credits may reset on your billing cycle, expire, or be subject to plan limits, and unused credits have no cash value. If your credits are exhausted, some features may be unavailable until your credits are replenished or your plan renews.

4.7 Lifetime Licenses

We may offer one-time "lifetime" licenses, including through third-party marketplaces such as AppSumo. Lifetime licenses are governed by the plan features and tier limits in effect at the time of purchase, and by the marketplace's own purchase, activation, and refund policies. Refunds for a marketplace purchase are handled under that marketplace's policy rather than Section 4.4. "Lifetime" refers to the lifetime of the Services as offered and does not guarantee that the Services will be provided indefinitely. Nothing in this Agreement, including the disclaimers and limitations in Sections 9 and 10, limits any refund right or buyer guarantee that a marketplace such as AppSumo separately provides to you.

5. AI Features, Your Content, and Responsibilities

5.1 AI-Generated Output

The Services generate and transform content using artificial intelligence. AI output may be inaccurate, incomplete, outdated, not unique to you, or unsuitable for a particular purpose. You are responsible for reviewing, editing, and verifying any AI-generated content before you rely on it or publish it. As between you and us, and to the extent permitted by applicable law and by the relevant AI provider's terms, you own the output generated for you through the Services.

5.2 Your Content

You retain all rights to the text, images, and data ("User Content") you post, upload, or schedule via Feedboss.ai. By using the Services, you grant us a limited, non-exclusive license to host, process, and transmit your User Content, including to the third-party providers described in our Privacy Policy, solely for the purpose of providing the Services to you.

5.3 Bring Your Own Key (BYOK)

Some plans allow you to connect your own third-party AI provider account by supplying an API key. You are responsible for your own keys, provider accounts, usage, and any fees or charges those providers impose. Your use of a connected provider is governed by that provider's terms, and we are not responsible for that provider's availability, output, or data practices.

5.4 Your Responsibility and Platform Compliance

You are responsible for the content you publish through the Services and for ensuring that your use of the Services complies with the LinkedIn User Agreement and all applicable platform policies and laws.

6. Acceptable Use Policy

You agree not to misuse the Services. Prohibited actions include, but are not limited to:

• Reverse Engineering: Attempting to decompile, reverse engineer, or copy the source code of the Platform.
• Unauthorized Access: Accessing the Service by any means other than through the interfaces provided by Feedboss.ai.
• Harmful Activity: Transmitting viruses, malware, or any code of a destructive nature.
• Spamming: Using the Service to send unsolicited bulk messages or engage in harassment.
• Reselling: Reproducing, duplicating, selling, or reselling any portion of the Service without express written permission from us.

7. Intellectual Property Rights

The visual interfaces, graphics, design, compilation, computer code, and software that make up the Services are the property of Feedboss.ai and are protected by copyright, patent, and trademark laws. Nothing in this Agreement transfers ownership of the Services to you. Your rights in your own User Content and in the AI output generated for you are addressed in Section 5.

8. Data Privacy & Analytics

8.1 Data Usage

Our collection and use of personal data are governed by our Privacy Policy. By using the Service, you consent to such processing, including the transmission of your content to the AI and infrastructure providers described there.

8.2 Service Improvement

We may collect and use usage data, including in aggregated or de-identified form, to improve the functionality, quality, and performance of the Services.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Feedboss.ai expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that any AI-generated output will be accurate, unique, or fit for your intended use.

10. Limitation of Liability

To the maximum extent permitted by law, Feedboss.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any AI-generated output or your publication of it; or (d) unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Feedboss.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, the content you publish, or your violation of these Terms.

12. Governing Law & Dispute Resolution

12.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-laws principles.

12.2 Jurisdiction

You agree that the state and federal courts located in New York shall have exclusive jurisdiction over any dispute arising out of or relating to this Agreement, except where mandatory consumer-protection laws of your place of residence provide otherwise.

13. General Provisions

13.1 Modifications

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to access the Service after changes become effective, you agree to be bound by the revised Terms.

13.2 Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

13.3 Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Feedboss.ai regarding the use of the Services.
